Atlantic Vacation Rentals

1. Conclusion of Contract
1.1 Atlantic rents out the holiday accommodation offered in its own name and on its own account.
1.2 By submitting a booking request, the customer makes an offer. The contract is concluded when Atlantic issues a booking confirmation. The booking confirmation determines the contents of the contract.
1.3 Atlantic engages the owners and independent local service providers to carry out its services. They are not authorized to make declarations on behalf of Atlantic.
2. The Accommodation
2.1 The accommodations are privately used vacation homes. The property description determines the condition provided.
2.2 Amenities such as air conditioning, pool heating, Wi-Fi or a fireplace are included only if specified in the property description, and only for the rooms and periods stated there.
2.3 Accessibility or disability-friendly amenities are only provided if expressly confirmed in the booking confirmation. Customers must inform us of any specific accessibility or usability requirements before booking so that we can assess whether a property is suitable.
2.4 Impacts from the surrounding area that are not attributable to Atlantic, such as road traffic, farming, events or construction work on neighboring properties, do not constitute a defect if they are customary for the area and were unknown to Atlantic when the contract was concluded. Atlantic will disclose any significant disturbances it is aware of before booking.
3. Price and Payment
3.1 25% of the rental price is due upon receipt of the booking confirmation, with the balance payable no later than 21 days before arrival.
3.2 The rental price is the final price and is payable to Atlantic. The booking confirmation specifies which additional costs and charges are included.
3.3 If the customer fails to pay on time, Atlantic may withdraw from the contract after an unsuccessful reminder and a reasonable grace period, and settle the account in accordance with section 4.2.
4. Customer cancellation
4.1 The customer may cancel at any time before arrival. Cancellation must be submitted to Atlantic; the date it is received shall apply.
4.2 In the event of cancellation or failure to arrive, the following compensation is payable, based on the rental price:
● up to 60 days before arrival: Free cancellation
● 60 to 31 days before arrival: 50% of the total rental price
● 30 days or less before arrival: 100% of the total rental price
The customer reserves the right to prove that no damage or significantly less damage was incurred.
4.3 We recommend taking out travel cancellation insurance.
5. Stay
5.1 The accommodation may only be occupied by the number of people stated in the booking confirmation; children count as guests.
5.2 Tents may not be erected, and motorhomes or caravans may not be parked overnight, on the accommodation’s property.
5.3 If you breach Section 5.1 or 5.2, Atlantic may deny access, require a reasonable additional payment or, in the case of serious breaches, terminate the contract for good cause.
5.4 Check-in and check-out times and any security deposit are specified in the booking confirmation. The security deposit will be settled after the accommodation has been returned.
5.5 The customer is liable for any damage caused by them or their fellow travelers.
6. Defects
6.1 Any defects must be reported without delay to the contact specified in the travel documents so that they can be remedied.
6.2 If the customer culpably fails to report the issue, they forfeit any claims that could have been avoided had it been reported promptly.
6.3 Atlantic may also remedy the issue by providing another accommodation of equivalent quality.
7. Liability
7.1 In the event of injury to life, body, or health, as well as in cases of intent or gross negligence, Atlantic shall be liable in accordance with statutory provisions.
7.2 In the event of a slightly negligent breach of material contractual obligations, liability is limited to foreseeable losses typical for the contract. In all other cases, liability is excluded.
8. Data protection
Atlantic processes personal data to perform the contract. For details, please see the Privacy Policy.
9. Final Provisions
9.1 German law applies. Mandatory consumer protection provisions of the country in which the customer has their habitual residence remain unaffected.
9.2 Atlantic does not participate in dispute resolution proceedings before a consumer arbitration board.
9.3 These General Terms and Conditions were drawn up in German. Versions in other languages are translations; in the event of discrepancies, the German version shall prevail.
